CFTC proposes rule on whistleblower awards, creating presumption of maximum payouts on smaller claims

The Commodity Futures Trading Commission has proposed a rule establishing a rebuttable presumption of a 30% award for whistleblowers whose cases generate total sanctions of $5 million or less. Approximately 82% of historical awards paid by the program fall into this smaller-claims category, covering the vast majority of future cases. This approach directly mirrors the SEC’s regulatory framework to harmonize practices between the two agencies. Since its inception in 2011, the program has distributed over $430 million in awards, corresponding to more than $3.7 billion in monetary sanctions. The proposal, published on June 11, 2026, has not yet been formally adopted as of this date.
