Former FTX CEO Sam Bankman-Fried was convicted in 2023 and sentenced to 25 years in prison and ordered to pay $11 billion in forfeiture on seven felony fraud counts related to the misuse of customer funds. After losing his appeal to the Second Circuit in 2026, his attorney Jeffrey Fisher is asking the US Supreme Court to review the case, arguing that evidence of victim losses was inadmissible and that the $11 billion forfeiture violates the Eighth Amendment’s prohibition on excessive fines. The Court granted the government an extended deadline of November 16 to respond to the petition, which could allow justices to decide whether to hear the case by late 2026 or early 2027. If SCOTUS accepts the case, a decision could be issued by June 2027 or during the following term.
