To secure the seven Democratic votes needed to reach the 60-vote threshold in the Senate, the bill removes explicit criminal protections for blockchain developers under 18 U.S.C. § 1960, while adding ethics bans preventing officials from holding more than $15,000 in digital assets and expanding enforcement powers for state attorneys general. Sponsors Senators Cynthia Lummis, John Boozman, and Tim Scott have framed these concessions as necessary to achieve bipartisan support. The cloture vote is scheduled for September 15.
