Ripple Pioneer Returns to SEC Case After Spotting Familiar Tactics Outside Crypto

David Schwartz, XRP Ledger co-creator and CTO Emeritus at Ripple, has drawn a parallel between the tactics used by the SEC in the Ripple case and an unrelated legal proceeding. In this case, a major private manufacturer is challenging Connecticut state legislation restricting the sale of certain product categories, arguing that the state attorney general’s office is deliberately refusing to clarify the criteria for determining legality, creating impossible conditions to meet. Schwartz described this government strategy as « grossly unfair, » defining it as an approach that forces businesses to comply with rules that are impossible to verify. The SEC v. Ripple case involved allegations of selling more than $1.3 billion worth of unregistered securities through the XRP token, with the defense specifically citing the regulator’s failure to provide clear and transparent rules.
