The SEC amended its quorum rule on September 30, 2026, allowing a single commissioner to act on behalf of the agency when all others are disqualified due to ethics rules or conflicts of interest. The change took effect on October 2, 2026, the same day Commissioner Hester Peirce went on leave, leaving the commission with only two active members out of five. Several crypto proposals are still pending final decisions, including one on crypto-asset custody (comments due December 7, 2026) and an exemption under Regulation Crypto Assets (comments due October 20, 2026). The SEC frames the amendment as a practical fix to keep operations moving, while critics raise concerns about consolidated decision-making power resting with a single member.
