The U.S. traffic safety agency (NHTSA) is investigating Comma.AI after at least two serious crashes, one fatal, involving vehicles equipped with its open-source driver assistance system openpilot. The fatal crash occurred in Ascension Parish, Louisiana, involving a Toyota RAV4, while a separate injury crash took place in Cameron, Missouri, involving a Honda Accord traveling at approximately 82 mph. Some crashes appear to have involved third-party or forked versions of Comma’s software, raising critical questions about legal liability when open-source code is deployed in autonomous driving contexts. A civil lawsuit was filed by Kevin McGinnis on January 23, 2026, and later dismissed without prejudice in February 2026.
