CFTC Files Crypto Market Rulemaking With White House at Prerule Stage

The Commodity Futures Trading Commission filed a crypto market structure rulemaking with the Office of Information and Regulatory Affairs on September 17, with a ten-working-day review deadline expiring October 1. The filing comes two days after the Senate rejected the CLARITY Act by a 49-50 vote, falling 11 votes short of the 60 needed to proceed. The regulation, identified as RIN 3038-AF80 and titled « Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets, » is at the prerule stage, meaning no formal proposal has been published and no legal deadline applies. CFTC Chairman Michael Selig, the only sitting commissioner among five seats, had warned in August that he would use the agency’s existing authorities if the CLARITY Act stalled.
