Better Markets says the CFTC is the wrong cop for retail crypto

Better Markets, a financial reform advocacy group, criticized the CFTC’s proposal to oversee leveraged retail crypto trading on October 5, 2026. The U.S. regulator published an advance notice of proposed rulemaking covering two frameworks, Regulation CTX and Regulation CAM, with requirements including proof-of-reserves and market manipulation controls. Better Markets argues the CFTC, historically focused on institutional markets and lacking an explicit investor protection mandate, would leave retail investors less protected than under SEC oversight. The CFTC is acting under Section 2(c)(2)(D) of the Commodity Exchange Act with a 60-day public comment period. This move follows the Senate’s failure to advance the Clarity Act in September 2026.
