The House Ways and Means Committee will consider the 114-page Digital Asset Tax Certainty Act on Wednesday, Sept. 16, introduced by Chairman Jason Smith. The legislation would create a de minimis exemption for qualifying network or transaction fees of $10 or less, allowing taxpayers to disregard gains or losses on eligible fees. The bill would apply new federal tax rules to stablecoins, mining rewards, staking, lending and digital asset trading, while extending wash-sale rules to digital assets. Proposed exemptions would only take effect in 2028, and the bill must pass both the House, Senate and receive presidential approval before becoming law.
