Clarity Act Fails Again: What It Means for Crypto

The US Senate rejected a cloture motion on the Digital Asset Market Clarity Act, blocking the advancement of legislation that would have established separate regulatory categories for digital commodities and digital securities. The procedural vote required 60 votes, but the bill only had Republican support (53 seats), making it impossible to pass without at least seven Democratic senators. The House had passed the bill in July 2025 by 294 votes to 134, and the Senate Banking Committee had approved its version in May 2026 by 15 votes to nine. Republican leaders had released a revised 635-page version incorporating 126 changes sought by Democrats, including ethics restrictions on federal officials’ crypto holdings. The failed vote represents a significant setback for the crypto industry’s efforts to establish a clear federal regulatory framework, leaving the future of the proposed legislation uncertain.
