CLARITY Act 2.0: Failed Senate Vote Opens Door to a Rewrite

The U.S. Senate failed to invoke cloture on the CLARITY Act 2.0 (Digital Asset Market Clarity Act, H.R. 3633) on September 15, 2026, leaving the bill in limbo. The House of Representatives had passed the legislation with a lopsided bipartisan margin of 294-134 on July 17, 2025, making it the most credible market-structure vehicle to reach the Senate in years. The Senate Banking Committee reported the bill with a substitute amendment on June 1, 2026, and Senator Thom Tillis filed a motion to reconsider, keeping the measure alive. The bill grants the CFTC primary authority over digital commodity transactions, exchanges, brokers, and dealers, while the SEC retains jurisdiction over designated broker-dealer and alternative-trading-system activity. Banking trade groups are now pushing for changes to stablecoin-yield policy, which could become the main negotiating point in any rewrite.
