A federal judge in Mississippi refused to dismiss the NAACP’s lawsuit against SpaceXAI, the artificial intelligence division of Elon Musk’s conglomerate. The complaint, filed on April 14, 2026, alleges that the company operated between 27 and 69 gas turbines without the permits and pollution controls required under the Clean Air Act. The Southaven facility in Mississippi supplies the Colossus 2 data center in Memphis, Tennessee, and could emit between 1,700 and 5,000 tons of nitrogen oxides annually. The NAACP is seeking injunctive relief and civil penalties of up to $124,426 per day for each violation. The dismissal motion’s rejection means SpaceXAI must defend the allegations on the merits, while an injunction could force changes to the plant’s operations.
