Polymarket US sues Ohio over sports contracts enforcement

Polymarket US, through its CFTC-registered entity QCX LLC, filed a federal lawsuit challenging Ohio’s cease-and-desist orders targeting its sports-event contracts. The company argues that federal law under the Commodity Exchange Act and the Dormant Commerce Clause should override Ohio’s sports-gaming rules. The case, filed between October 16 and 19, 2026, also targets the OCCC’s licensing requirements and its position that the contracts constitute unauthorized sports wagering. It follows a September 25, 2026 ruling by the Sixth Circuit in KalshiEx LLC v. Schuler, which found that such contracts are not swaps and do not preempt Ohio’s laws, after which the state sent compliance letters to 10 prediction-market operators.
