Binance is under scrutiny from EU regulators for continuing to serve customers within the European Union without obtaining authorization under the MiCA regime. The European Securities and Markets Authority (ESMA) and national regulators are currently examining the legal basis for the platform’s continued operations. Binance failed to secure a license in Greece and allegedly relied on a regulatory loophole called reverse solicitation to maintain its services. Some European customers can still trade on the platform through entities based in Abu Dhabi, where Binance obtained full authorization in December 2025. The exchange could face enforcement measures and financial penalties if it exceeded what the exemption permits.
