Two lawsuits were filed by small businesses before the Court of International Trade challenging Trump’s sweeping tariffs on 60 trading partners. Implemented under Section 301 of the Trade Act of 1974, these tariffs cover 99% of U.S. imports and target imports produced by forced labor according to the administration. Learning Resources, which previously won a case at the Supreme Court, joined Burlap and Barrel and Collective Horology in filing the new suit, represented by Liberty Justice Center. The plaintiffs argue that the government did not adequately establish its case against each specific economy, as required by Section 301. Experts say it may be harder to successfully challenge these tariffs than previous rounds, as Section 301 tariffs survived court challenges during Trump’s first term.
