Sam Bankman-Fried, former founder and CEO of FTX, has asked the U.S. Supreme Court to revisit his criminal conviction and the $11 billion forfeiture imposed by American justice. Prosecutors demonstrated that FTX customers had lost substantial sums when their funds were transferred to Alameda Research. Bankman-Fried’s lawyers argue that this evidence was misleading and prejudicial, claiming that Alameda’s investments had sufficient value to cover liabilities and that customers may not have suffered any actual economic loss. The Second Circuit Court of Appeals had already rejected these arguments in June, noting that no one had consented to having their funds transferred to Alameda under false pretenses. Bankman-Fried is also challenging the forfeiture under the Eighth Amendment, viewing it as an excessive financial penalty, while prosecutors present it as a means to recover assets linked to criminal activities.
