Solana Policy Institute’s Kristin Smith warns crypto rules may be hard to undo

Kristin Smith, president of the Solana Policy Institute, warns that digital asset rules finalized by the SEC and CFTC before summer 2028 could prove difficult to reverse. The regulatory rulemaking process typically takes 18 to 24 months, and the Congressional Review Act provides only a limited window to overturn rules once established. The Clarity Act, which aimed to clarify crypto jurisdiction between the SEC and CFTC, failed in the Senate on September 15, 2026 with a 49 to 50 vote tally. The Solana Policy Institute held over 300 meetings with policymakers in 2026 and submitted a comment letter to the CFTC in July 2026, requesting exemptions for non-custodial wallet software and a 24/7 compliance framework.
