SEC proposes new crypto rules in absence of CLARITY Act

The Securities and Exchange Commission (SEC) has proposed new rules to regulate crypto assets after Congress failed to pass the CLARITY Act before the summer recess. These rules would create a tailored framework for investment contracts involving digital assets and would offer companies exemptions allowing token issuance of up to $5 million over four years and up to $75 million over twelve months. SEC Chair Paul Atkins stated that legislation remains indispensable to establish durable rules, while reaffirming the agency’s support for the CLARITY Act. The public will have 60 days to comment on these proposals after publication in the Federal Register.
