NFL Sides With States Against Kalshi in Supreme Court Prediction Market Fight

The NFL filed an amicus brief supporting New Jersey’s bid for Supreme Court review of a Third Circuit ruling that exempted Kalshi’s sports contracts from state gambling laws. In its brief, the league argues that sports contracts should fall under state gaming regulation rather than the CFTC’s exclusive jurisdiction under Dodd-Frank’s definition of a swap. The NFL is seeking bans on easily manipulated bets, a minimum trading age of 21, and league-specific lists of prohibited bettors. NFL-related contracts accounted for $1.8 billion out of the $3.3 billion traded across prediction markets on the season’s first Sunday. If the Supreme Court upholds the Third Circuit’s position, the NFL said it would redouble efforts to persuade regulators and Congress to adopt stronger protections before the 2027 season.
