The dispute centers on event contracts for sporting outcomes, including one tied to the 2027 Super Bowl, and raises questions about the regulatory authority of the Commodity Futures Trading Commission (CFTC) versus state governments. The NFL criticized the lack of sensible safeguards from the federal regulator. On Wednesday, 39 US states and the District of Columbia filed an amicus brief supporting New Jersey, describing the conflict as a national turf war requiring Supreme Court intervention. Kalshi has until November 9 to respond to the jurisdictional arguments.
