DOJ invokes Bitcoin Fog ruling in potential blow to Roman Storm acquittal bid

The U.S. Department of Justice is citing a September 25 appeals court ruling involving cryptocurrency mixer Bitcoin Fog to support its argument that New York courts have jurisdiction over parts of Roman Storm’s case. Prosecutors argued that Tornado Cash activity in Manhattan, where witness Shakeeb Ahmed used the service from his apartment, was sufficient to establish venue in the Southern District of New York. Roman Storm, a developer of Tornado Cash, was convicted in August 2025 of conspiring to operate an unlicensed money-transmitting business, but the jury deadlocked on money-laundering and sanctions-conspiracy charges. Judge Katherine Polk Failla has not yet ruled on the acquittal motion, and a retrial is scheduled for April 26, 2027.
