CFTC seeks public comment on proposed rule changes for CPO and CTA registration

The Commodity Futures Trading Commission (CFTC) is seeking public comments on proposed changes to rules governing commodity pool operators (CPOs) and commodity trading advisors (CTAs). The changes include modernizing the definition of Qualified Eligible Persons (QEPs), with updated portfolio thresholds that have not kept pace with decades of market growth. The agency also aims to codify existing no-action relief into permanent regulation, particularly exemptions for registered investment advisers managing eligible private funds. The proposals address reporting requirements for funds-of-funds structures, but notably do not address digital assets, as the CFTC continues to keep crypto regulation on a separate track. The comment period runs 60 days.
