Bitpanda fined in Austria’s first published MiCA penalty

Austria’s financial regulator FMA has fined cryptocurrency platform Bitpanda 70,000 euros for violating the European Union’s Markets in Crypto-Assets (MiCA) regulation. The company failed to submit a crypto-asset white paper to the regulator at least 20 working days before publication, as required under MiCA. Bitpanda also distributed marketing communications before publishing the required white paper and omitted mandatory disclosures in another marketing communication, including the statement that it had not been reviewed or approved by a competent authority, along with a required telephone number and email address. The penalty decision, issued under an expedited procedure, is now final.
