The Supreme Court declined on Monday to hear Gwynne Wilcox’s appeal challenging the legality of her firing by President Trump. Wilcox, a Democratic-appointed member of the National Labor Relations Board, was dismissed in January 2025 as part of Trump’s broader effort to reshape the federal government. The Court’s decision follows its June ruling supporting Trump’s firing of Rebecca Slaughter, another Democratic Federal Trade Commission member, effectively overturning a 1935 precedent that had limited presidential removal powers. Wilcox was the first Black woman to serve on the NLRB and had been appointed to a second five-year term in 2023 by President Biden. The appeals court ruling in December 2025 reversed a March decision that had upheld federal protections for NLRB officials from at-will dismissal.
