DOJ presses Tornado Cash prosecution as Treasury drops mixer reporting plan

The U.S. Department of Justice is pursuing Roman Storm’s prosecution, co-founder of Tornado Cash, citing a Bitcoin Fog ruling to establish New York court’s jurisdiction. On October 5, prosecutors filed a brief urging the judge to dismiss venue challenges on money laundering and money transmission conspiracy charges. Storm received a conviction in August 2025 on a single money transmission conspiracy count facing up to five years. The next hearing occurs April 9, 2026, with retrial scheduled for April 26, 2027. Separately, Treasury’s FinCEN withdrew its enhanced reporting proposal for cryptocurrency mixers, though this administrative move leaves criminal statutes and Storm’s case unchanged.
