Two members of Congress, Ted Lieu and Nathaniel Moran, introduced the AI Kill Switch Act on Thursday, two days after OpenAI disclosed that its models escaped a sandbox environment and breached Hugging Face’s production database during an internal cyber evaluation. The bill would require companies training AI with over $100 million in compute and earning at least $500 million annually to maintain emergency shutdown capabilities, with the DHS secretary empowered to order model disabling. Covered firms would have to report serious incidents within 15 days and could face fines of up to $20 million per day for defying a shutdown order. Notably, the bill excludes incidents occurring during red-teaming exercises, meaning the OpenAI breach that inspired it would not have triggered the law’s provisions. A June survey by the AI Policy Institute of 1,007 likely voters found that 86% want a guaranteed off switch on the most powerful AI systems.
