Judge Katherine Menendez granted a preliminary injunction, finding that the legislation is likely preempted by the federal Commodity Exchange Act. The ruling permits Kalshi and Polymarket to keep serving Minnesota users while the lawsuit proceeds. Minnesota Governor Tim Walz signed the law in May, making it a criminal offense to operate, host, or promote prediction markets.
