A Washington Post investigation published on August 27 found that at least a dozen US civil and criminal court cases over the past two years have referenced ChatGPT conversation logs as evidence. Courts treat these conversations as standard electronic records with no legal privilege: no attorney-client privilege, no therapist-patient confidentiality, and no Fifth Amendment protection. Law enforcement has retrieved queries directly from suspects’ devices, and OpenAI was ordered by a federal judge to produce 20 million de-identified conversation logs in copyright litigation. The US government sent 75 data requests to OpenAI between July and December 2025, with the company complying in 62 cases involving 84 accounts.
