How a DIY Adobe Illustrator design landed Rebel Creamery in a $23.8 million fight with Van Leeuwen

Rebel Creamery, a Utah-based low-carb ice cream maker, filed for bankruptcy on August 14 after a federal judge ordered it on July 16 to pay nearly $24 million to rival Van Leeuwen Ice Cream for trade-dress infringement. The dispute centered on the similarity between the two brands’ packaging: solid-colored pint containers with minimalist design and prominent black cursive lettering. Rebel admitted to designing its logo and packaging itself in 2017 using Adobe Illustrator without retaining any drafts or initial design records. The design studio Pentagram, which had documented every iteration of Van Leeuwen’s packaging, provided critical evidence in court. Van Leeuwen had initially sought $36.4 million in damages based on its competitor’s profits.
