Two small businesses filed a lawsuit in the U.S. Court of International Trade just hours after new tariffs covering 99.4 percent of U.S. trade took effect on goods from more than 80 countries. The plaintiffs argue that the Trump administration is using Section 301 of the Trade Act of 1974 as a pretext to recreate the global tariff regime that the Supreme Court struck down five months earlier. Experts are divided, with some like Kimberly Clausing and Alan Wolff stating the tariffs are clearly unlawful, while others like Greta Peisch say the administration followed required legal procedures and it would be difficult to challenge. The case, brought by the Liberty Justice Center which previously helped invalidate the IEEPA tariffs, could take years to resolve.
