Crypto ATM firm Athena Bitcoin has agreed to a $4.5 million settlement over telemarketing texts sent to recipients who had requested to stop receiving messages. The settlement will face final review in federal court on August 10. The case alleges that Athena sent promotional texts to consumers after they had explicitly requested to opt out. Class counsel intends to seek 33% of the fund, or $1.48 million, plus litigation expenses up to $30,000, potentially leaving less than $3 million for claimants. Athena Bitcoin has denied any wrongdoing.
