SEC Chair explains why NFTs typically fall outside of securities laws

SEC Chair Paul Atkins outlined on CNBC the agency’s new regulatory approach to digital assets, marking a break from the previous strategy of regulation through enforcement. He identified tokenization as a key innovation that regulators should support rather than restrict. Atkins stated that past regulatory missteps have left the United States lagging behind in crypto development by as much as a decade, and vowed to reverse that trend. Regarding NFTs, he confirmed they typically fall outside of securities laws. This recalibration aligns with the more crypto-friendly Trump administration that took office in early 2025.
